The Partner Visa allows married (opposite-sex) and de facto (including same-sex) partners of Australian citizens, permanent residents, or eligible New Zealand citizens to live in Australia. At NextGen Migration, we ensure a seamless application process, guiding you through each step with personalized support and expert advice.
This visa is categorized into two main types: Prospective Marriage Visa and Partner Visa. The type of visa you apply for depends on whether you are in an intended marriage or a de facto relationship. We’ll assist you in choosing the appropriate option based on your unique relationship status, ensuring that you meet all the criteria.
Our team is dedicated to delivering precise and efficient support to help you achieve your immigration goals.
The Partner Visa is available in two forms: temporary and permanent. Initially, applicants who meet the required legal criteria are granted a temporary visa. After meeting eligibility criteria, or after a certain period (often depending on the long-term relationship or children involved), a permanent visa may be granted.
This visa is specifically designed to allow partners (spouse or de facto partners, including same-sex partners) of Australian citizens, permanent residents, and eligible New Zealand citizens to live in Australia. Additionally, individuals engaged to be married may apply for the visa as part of their future plans to live in Australia with their Australian partner.
However, as the partner of an Australian citizen, permanent resident, or eligible New Zealand citizen, you are not automatically eligible for permanent residency. If you wish to live permanently in Australia, you must first apply for a permanent visa and meet the legal criteria for its approval.
If you are already in Australia, you can apply for a Partner Temporary Visa (Subclass 820) and a permanent visa (Subclass 801). For this visa, your partner must be an Australian citizen, permanent resident, or eligible New Zealand citizen. If your relationship remains genuine and continues for two years after applying, you may be granted a permanent visa.
If you are applying from outside Australia, you can apply for the Partner Temporary Visa (Subclass 309) and Permanent Visa (Subclass 100). Your partner must be an Australian citizen, permanent resident, or eligible New Zealand citizen, and a genuine relationship for two years will lead to a permanent visa.
For those planning to marry, the Prospective Marriage Visa allows entry before marriage. To apply, your fiancé(e) must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen. Once married, visa holders can apply for a Partner visa to stay permanently.
To be eligible for applying this visa, the following general conditions must be met:
You must be sponsored by a person (your fiancé(e), partner, or in some cases, a parent or guardian of your partner), who is an Australian citizen, permanent resident, or eligible New Zealand citizen and satisfies the legal requirements for being a sponsor.
You must meet the health and character criteria.
If you have dependent children or other dependent family members, they may be included in your application, provided they meet the necessary requirements.
This visa allows offshore partners of Australian citizens, permanent residents, or eligible New Zealand citizens to join and live in Australia.
This visa is for partners already in Australia, allowing them to stay temporarily while applying for a permanent partner visa after eligibility.
This visa is for individuals outside Australia intending to marry an Australian citizen or permanent resident, allowing entry to marry and apply for permanent residency.
A Partner Visa allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. It includes temporary and permanent visa options.
Once granted, a Partner Visa can allow you to stay in Australia permanently. Initially, you will be granted a temporary visa, which may lead to permanent residency after two years or upon assessment.
Eligibility typically requires that the applicant is in a genuine, committed relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. The applicant must also meet health and character criteria.
Yes, you can include your dependent children on your Partner Visa application if they meet the necessary requirements. Family members will be assessed as part of the application process.
To apply for a Partner Visa, you must submit an online application through the Australian Department of Home Affairs. It’s important to include all necessary documents and prove the legitimacy of your relationship.
A Partner Visa, once granted, provides a pathway to permanent residency. If you hold a temporary visa and meet all requirements, you may be granted a permanent visa after two years, or sooner depending on the relationship's status.
